Article 1. Definitions

The terms and expressions used in these terms and conditions have the following meanings:

• Customer: Any natural person of legal age who purchases one or more vehicles from Motive Motion, where the purchase is not made within the scope of their professional activity and who is considered a consumer.
• General Terms and Conditions: These general sales terms and conditions applicable to the relationship between Motive Motion and the Customer.
• Specific Terms and Conditions: The special conditions specified in the offer that define the characteristics, quantity, and price of the vehicles as well as the delivery conditions. The Specific Terms and Conditions supplement these General Terms and Conditions.
• Agreement: The General and Specific Terms and Conditions together, which constitute the contract between the Customer and Motive Motion upon the Customer's signing of the offer.
• Website: The Motive Motion website, available at www.motive-motion.com.
• Vehicle: The vehicles offered by Motive Motion that are purchased by the Customer.

Article 2. Acceptance of the General Terms and Conditions

By purchasing a vehicle, the Customer confirms full and unconditional acceptance of these General Terms and Conditions. The Customer declares that they are of legal age and have the capacity to enter into the Agreement. If the Customer does not agree with the General Terms and Conditions, they are requested not to complete the purchase.

Article 3. Vehicles

The vehicles offered by Motive Motion comply with applicable European laws and regulations and are suitable for sale in approved regions. The characteristics of the delivered vehicle are specified in the Specific Terms and Conditions.

Article 4. Formation of the Agreement

The Customer can order a vehicle via the Website by configuring the vehicle and entering their details. Based on this, Motive Motion will prepare an offer and send it to the Customer. The offer is valid for 15 days. Once the Customer accepts and signs the offer, the Agreement is concluded.

Article 5. Price and Payment

• Price: The price of the vehicle is specified in the Specific Terms and Conditions and includes VAT but excludes shipping costs, insurance, and other additional charges.
• Payment Terms: Payment must be made in euros via bank transfer.

Article 6. No Right of Withdrawal

The Customer acknowledges that no right of withdrawal applies to this Agreement, as the vehicle is a clearly customized product.

Article 7. Delivery

The delivery of the vehicle takes place at the location of Motive Motion or, if otherwise agreed, at the address specified in the Specific Terms and Conditions. The Customer is responsible for any additional costs such as transport, insurance, and import duties.

Article 8. Liability of Motive Motion

Motive Motion is only liable for direct damage resulting from proven errors or negligence. Liability is limited to actual damages, excluding indirect damages such as loss of profit.

Article 9. Warranties

The Customer is entitled to the statutory warranty of conformity and the warranty against hidden defects, as described in Dutch legislation. Additionally, Motive Motion offers a commercial warranty on the vehicle, including parts and labor, for a period of 24 months.

Article 10. Processing of Personal Data

Motive Motion processes the Customer's personal data in accordance with the General Data Protection Regulation (GDPR). For more information on the processing of personal data, the Customer can refer to the privacy policy on the Website.

All communication via email is intended solely for the recipient and may contain confidential information. If you receive an email in error, please notify us immediately and delete the email.

Article 11. Intellectual Property

All intellectual property rights relating to the vehicles and associated materials remain the full property of Motive Motion or its partners.

Article 12. Applicable Law and Disputes

The Agreement is governed by Dutch law. Any disputes will be submitted to the competent court in the Netherlands.

Article 13. Modification of the General Terms and Conditions

Motive Motion reserves the right to amend the General Terms and Conditions at any time. The amended terms will take effect from the date of publication on the Website.
